Brazil’s protracted regulatory process for energy storage systems continues to hinder investment and project development just as the country’s power grid faces critical flexibility and supply challenges. The trajectory for establishing clear operational, licensing, and tariff frameworks remains uncertain, delaying large-scale battery deployment despite growing renewable generation.
The Brazilian Energy Regulatory Agency (ANEEL) has postponed finalizing its long-awaited energy storage regulations once again, causing mounting concern within the sector. The regulatory review, initiated in 2019 and formally debated since August 2025 under Consultation Public No. 39/2023, stalled after new revision requests by agency directors. Key regulatory decisions such as tariff design, licensing procedures, and legal status of storage assets have been technically settled with support from ANEEL’s legal advisors and the Federal Prosecutor’s Office. However, debate interruptions and proposals to re-open public consultation threaten to derail progress. The Brazilian Battery Energy Storage Association (ABSAE) has issued warnings that further delays risk stalling investments and worsening the grid’s operational inflexibility, which currently forces over 20% curtailment of wind and solar energy. Adding urgency, Brazil faces prolonged droughts stressing hydroelectric production and sharply increasing energy costs, while underscoring the need for storage to balance peak demand, especially overnight.
Recent regulatory clarifications from February 2026 introduce “dual tariffs” for battery systems, requiring storage to pay network usage fees on charging and discharge cycles, establishing a distinct legal category for storage agents, and maintaining that capacity reserve costs be allocated fully to generators, cushioning consumers from direct charges. ANEEL’s first authorization of a grid-coupled battery system linked to a solar plant in Bahia also demonstrates practical steps toward integration, but full-scale procurement remains stalled. The postponed 2025 capacity reserve auction, which could have contracted battery storage alongside thermal and hydro resources, remains on hold pending regulatory clarity.
Market players highlight high electricity tariffs in industrial regions and expanding distributed solar generation as strong drivers for behind-the-meter storage. Yet persistent regulatory uncertainty continues to block project finance and broad adoption. Brazil’s capacity to resolve storage frameworks promptly will be central to enabling grid modernization and effective renewable integration in the coming years.
