The framework establishes the National Hydrogen Program and the Low-Carbon Hydrogen Development Program while enabling fiscal credit concessions for producers and consumers between 2028 and 2032 under Law 14.990/2024. However, temporal misalignment between legislation and implementing decrees creates regulatory uncertainty that conflicts with sector investment cycles.
Three critical enablers remain unaddressed for project execution. Demand induction for green ammonia, methanol and fertilizers requires development of both export markets and domestic offtake, while energy price volatility undermines economic modeling for electrolysis operations dependent on continuous renewable power supply. The absence of clear, stable public policy compounds these challenges, with fossil fuel subsidies creating market distortions. Brazil lacks mature infrastructure for hydrogen transport via pipelines or vessels, large-scale storage facilities, and domestic supply chains for specialized equipment including electrolyzers, compressors and storage tanks, forcing reliance on imported components that elevate capital expenditure. The White Martins facility in Jacareí, São Paulo and the Neoenergia plant in Brasília represent the only operational green hydrogen production sites, highlighting the gap between announced initiatives totaling over 70 projects in various development stages and commercial-scale deployment. Secondary regulations governing interstate transport, storage protocols and low-carbon thresholds remain pending, with legal experts warning that regulatory delays risk creating fragmented state-level frameworks rather than coherent national standards.
